General Terms & Conditions of SwissProsthetics

1. Scope of application
These General Terms and Conditions (hereinafter “GTC”) apply to all business relations between SwissProsthetics (hereinafter also “the company”) and its customers, website visitors, interested parties in products etc (hereinafter “customers”), in particular also via the domain “www.swissprosthetics.com“. If the company should agree upon deviating regulations in offers or individual agreements with customers, these individual agreements take precedence.
Deliveries, services, offers, but also information on products of the Company or on the Company itself are provided exclusively on the basis of these GTC. Deviating provisions of customers shall only apply if they have been expressly agreed with the Company in writing.
General terms and conditions of customers are not accepted and do not apply to the relationship between the Company and the customer. This shall also apply in the event that the Company has not expressly objected to such general terms and conditions.
2. Exclusion of liability
All information presented has been compiled with due care. Insofar as product information is available for a product, the information on the website corresponds to the product information in terms of application, performance and effectiveness, unless a classic sales-promoting statement is made. Nevertheless, no guarantee is given for the correctness, completeness or topicality of the information provided.
If the customer contacts the company by e-mail, communication is not encrypted. The customer agrees to this, and any liability for defilement as a result of such communication is excluded.
Liability claims against the Company for material or immaterial damages arising from access to or use of the published information and the website as a whole are excluded.
References, links to third party websites and web services of third parties are outside our area of responsibility. Any responsibility for such websites or services is excluded to the extent permitted by law. SwissProsthetics dissociates itself furthermore hereby expressly from all contents on any externally linked pages. Responsible for such websites are exclusively these third parties. Access and use of such websites or services is at the user’s own risk.
3. Adaptation of the website
This website and its content is administered by SwissProsthetics. We reserve the right to change the contents of our website completely or partially at our own discretion at any time without prior notice and/or to even stop its operation.
4. Products shown
The products shown and recommendations for product combinations show restoration examples and a selection of SwissProsthetics products. No statement is made for other products.
Whether a product is actually suitable for you and whether you will be able to fully exploit the functionality of a product depends on many different factors. Decisive factors include your physical condition, your fitness and a detailed medical examination. Have your doctor and/or medical supply store inform you about treatment, contraindications and possible risks. Please also read the product information and instructions for use.
5. Copyright notice
The website as well as the photos posted on the website and the texts we have created are protected by copyright. Each use, duplication or utilization (also only in part) is therefore forbidden without express written agreement of SwissProsthetics.
6. Final provisions
The assignment of rights arising from the relationship between the Company and the Customer is not permitted without the express consent of the Company. The Customer shall then waive any set-off against the Company.
Unless otherwise contractually agreed, the place of performance for all obligations of the contracting parties shall be the Company’s registered office in Switzerland, or in the absence of a registered office, the address listed in the imprint.
Should individual provisions of these General Terms and Conditions be or become ineffective in whole or in part or should the agreements contain a loophole, the validity of the remaining provisions shall not be affected.
7. Applicable law
All legal relationships between the company and the customer are subject to substantive Swiss law, excluding the Vienna Convention on the International Sale of Goods.
The ordinary courts at the Company’s registered office shall have exclusive jurisdiction for the judicial assessment of all disputes between the Customer and the Company; in the absence of a registered office, the address listed in the imprint shall apply. A lawsuit of the company at the seat/residence of the customer is permissible.
